Effective date: 1 January 2026. Enterprise agreements supersede these standard terms where a signed agreement exists.
By accessing or using the PHALANX platform, you agree to be bound by these Terms of Service and all applicable policies. Any separate written agreement with BreaktroughF1 LLP supersedes these terms where applicable.
PHALANX grants you a non-exclusive, non-transferable license to access the platform during the subscription term solely for your internal security operations. PHALANX Suite software is proprietary — no rights to source code are granted.
You may not use PHALANX to attack systems you do not own or have explicit written authorization to test. SPECTRA and other offensive capabilities are licensed for authorized use only. Unauthorized use is grounds for immediate termination.
All security telemetry and data you input into PHALANX remains your property. BreaktroughF1 LLP does not claim ownership of customer data.
PHALANX does not currently offer a formal uptime SLA. Availability targets will be published and formalized as hosted services move into production.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREAKTROUGHF1 LLP'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM. BREAKTROUGHF1 LLP IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
These Terms are governed by the laws of India. Any disputes are subject to the jurisdiction of the courts of Kerala.
